To Whom It May Concern:
I represent the Venice Chamber of Commerce ("Venice Chamber") with regard to its intellectual property matters. The Venice Chamber is the owner of the VENICE & Design trademark (shown here Trademark Status & Document Retrieval) for "Chamber of Commerce services, namely, promoting business and tourism in the Venice, California area." The Venice Chamber is also the owner of federal trademark registration number 3,565,742 for the VENICE & Design mark.
The physical embodiment of the Venice Chamber's iconic trademark appears as a lighted sign hung above Windward Avenue in Venice, California. The Venice Chamber has invested considerable time and effort in promoting its services in connection with its trademark since at least as early as October 2008. As a result, it has developed a significant amount of goodwill in its trademark. The sign identifies the Venice Chamber.
The Venice Chamber has licensed the use of its mark for a variety of products and services. The licensed uses of the mark have appeared in photographs, motion pictures, television commercials, web advertisements and paintings. The licensed uses of the VENICE & Design mark inure to the benefit of the Venice Chamber.
It has recently come to the Venice Chamber's attention that, without its knowledge or consent, Tech.. has uploaded a video containing the Venice Chamber's mark in an advertisement for Microsoft computers. A copy of the video can be found here: youtube/watch... This is an unauthorized use of the VENICE & Design mark, which is likely to cause confusion, mistake or deception amongst consumers who are likely to believe that the Venice Chamber sponsors, endorses or is affiliated or associated with Microsoft or that it has licensed the use of its mark to Microsoft, none of which is the case. Tech.. may be contributorily liable for trademark infringement by making the advertisement available and deriving any benefit from such actions.
As you are no doubt aware, trademark owners must make an effort to stop unauthorized uses of their trademarks or risk impairing those rights. As such, the Venice Chamber requests that Tech... immediately remove the offending advertisement from Youtube. The Venice Chamber would like Tech..'s assurances that the ad will be removed not only from Youtube, but from any other location where the ad may be viewed including, but not limited to, other websites and broadcast television commercials. Please confirm in writing that Tech... will not use the Venice Chamber's trademark without the express written permission of the Venice Chamber.
Please acknowledge receipt of this message no later than Wednesday, December 18 by sending an email to [email protected] so the Venice Chamber knows this message was received. If no acknowledgement is received by then, the Venice Chamber will submit a takedown request via YouTube's trademark complaint form.
